Grounds for Annullment

My brother married a gal in CA in Dec 2007 that was on parole in a drug treatment center. She said she loved him, blah blah but now it appears she married him for the purpose of having a home to be paroled to, as well as someone to pay her restitution, etc. Plus we recently found out that she married someone on 2001 and is never got a divorce or annullment. Can my brother seek an annullment with fraud or bigamy as grounds rahter than a divorce?

One final point, my brother and this woman had a child. Does that make a difference in divorce or annullment?

In a general sense, bigamous marriage would qualify for an annullment and would be easier to prove than fraud.
