Legal Question in Family Law in California

My husband and I filed for divorce. He is the petitioner and I am the respondent. When he filed, he signed papers saying he lived in the county of filing for at least three months prior. He in fact did not. Does this give me grounds to file for a fraudulent filing on his part and have it thrown out and a new one started??

Yes, but this is a very complicated analysis. One question you should ask yourself is whether or not it is better for you to leave the case in the jurisdiction it was filed. I suggest you consult with an attorney as soon as possible.
