Legal Question in Family Law in California
I live in California and divorced. The divorce spells out that I need to pay my ex monies each month for her and her daughter's health insurance ($683). She just inherited a estate valued at $4.5 million and combined with her estate $5.9 million. My net worth is minus $0. My net income is less than $2000 a month (mortgage industry). If I miss the payment that is due Oct 20th, I will get a email from her attornye threateing to file a Contempt Of Court.
Question: If they file a Contempt, how long does it usually take to get into Court.
If I file a Order To Show Cause after I am served, would this order go into the same Court, so that the Judge who is looking at the Contempt could rule on the Order to Show Cause.

You need to file an OSC to modify right away. Back support with interest continues to accrue even though you're entitled to a reduction in support, until you file. Once you file, the change is retroactive to when you filed, but not before.
