Legal Question in Family Law in California

move away parent

i have two with my ex- ages 11&9 i am remarried and want to move to oklahoma with my husband ,i have sole physical custody and my ex sees his kids once a week ,his new wife is making their visit uncomfortable since she had her own kids,they've been living with me pretty much their entire lives ,the cost of living is cheaper ,they will be enroled in a private school and we can afford ahouse ,but still my ex is being selfish ,i know my kids will choose to live with me if they were asked by a judge ,but i don't want them to hurt the dad's feelings ,i also know they don't want to visit him because of his wife ,we moved away before and lived in washington for 4 years and they had a better relationship with him then,they sleep on his couch because he can't afford a bigger house ,but he still refuses to look in a cheaper stare or to allow me to move ,what should i do?

You will need to file a motion requesting a court order allowing you to move. Retaining an attorney to assist you will increase the probability of success.
