Legal Question in Family Law in California

The right to move out of state

I would like to leave CA next year after my older boys graduate from High School. I have a younger son 8, from a different father, and we share joint custody, though I have him 65% of the time. After the loss of child support, the high cost of living in Sonoma County I cannot afford to live here. I cannot make ends meet now and have lived off savings and equity in my home to stay for the last two years. I have 1/2 interest in a home in Arizona and would like to move there. I would be able to work part time and pick him up from school everyday. Currently, I work fulltime and don't get home until 6:00pm and his oldest brother cares for him. He will no longer be available to do this because he will be going off to college. I think my son's father will object to this move. What are my chances?

Thank you.

Re: The right to move out of state

You should immediately attempt to negotiate an agreement with the father for your move to Arizona. If he is not willing to agree then file a motion with the court. You have a very good chance of getting an order allowing the move.
