Legal Question in Family Law in California

Seperated in1977-never got divorce.

We were married in 1975 and seperated in '77-no kids or property to speak of at that time. We last contacted each other in '84-we never got a divorce. I saw some county records that indicate she (my ex?) has remarried. How can I go about getting a divorce after such a long length of time.

If your wife was remarried, she may have gotten a divorce based on default. You may be divorced so you need to search the records and before you do, maybe confirm her marriage.

In a general sense, you would have to file and serve her just as if you had done so a long time ago. The length of time since the separation has no bearing on the process of obtaining a legal divorce.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
