Legal Question in Family Law in California
My sons mother and I haven't been maried. Well its like this, She gots my son with her. She has no where to go, she stays with her mother in a little motel room. We had a depart of child and family case open on us,(social services). She used crystal meth when she was pregnant and they took my son away. I fought for him of course. After a real long two months I finally got him back to me. She and I started talking and she said how much she had changed. Well she fooled the hell outta me. Now that the case is closed. well let me say we just been having nothing but problems. I know she been using because, I had my son for the weekend and when she said she was coming to pick him up she never showed. Well later that at like 12 a.m she decides to come. I didnt let her take him she looked all wired. I made her leave. Well the next day she came and to avoid the cops because im on felony probation. I gave her my son. I want my son back. Im miss him so much. Im real worried about him. Can you help me please?

Who has custody? If you have custody, you shouldn't have to big of a problem getting him back. If you have paperwork, you might be able to go pick him up, or to get the police or social services to help you. If you do not have custody, you may need to file for custody.
