Re: can a wife leave state with children

There are provisions for a parent to flee the state with children when necessary for safety. However, the safer approach is to obtain a domestic violence restraining order and with that order request permission to move to the other state and keep your address confidential. If you just move and the court doesnot agree that the move was necessary to prevent harm to the parent or child, the court could order the children returned to California.
