Legal Question in Civil Litigation in California

My ex boyfriend abused me for years and admitted it in court can I sue him for d

My ex-boyfriend abused me for approxiamtely 13 years. He choked, punched, used things to hit me with like a chain saw that he broke while trying to pull the chain to turn it on and instead hit me with it, he once punched me in the stomach while I was eight months pregnant and had once spun my car out in the middle of the road using his own vehicle, then there is also the verbal and mental abusethat I recieved. There are more things (to many) than that to add but you get the idea. While attending a family court hearing I presented the Judge and mediator with a taped conversation where my ex admitted to some but not all of the abuse. The tape was accepted as evidence as during the taping my ex had made a comment that he knew he was being taped and said he didn't care. I am suffereing from PTSD from the abuse I had recieved from my ex and I probably will for a long time to come. I feel that my ex should be held accountable for his actions. The statute of limitations is not up as to the dates when he admits the abuse occurred and I would like to know if I can sue him for monetary damages.

Sure, you can sue, IF at least some of the assaults occurred within the last year, and IF there is any reasonable potential to actually collect enough money from him to justify the expense of the lawsuit. Anybody can sue anybody for anything. Collecting money is another issue.

Thanks for your posting, and I'm very sorry to hear about your abuse. As you can see by the answers to date, proving your case is one thing (and you do have an excellent chance of doing so with the facts you have given), but collecting is another matter, and may not be easy in your case.

You shouldn't delay even if you are within the statute of limitations however. If you'd like to speak about this more, please feel free to email me, or call me, toll free, at 1-877-568-2977. I'm happy to help in any way that I can.
