Legal Question in Civil Litigation in California

Car in garage for repair - stolen - sold & recovered by police what is my respon

Car in garage for repairs of 1100.00 but was stolen before I got it. Keys missing from garage. Car sold. Most stuff in car removed, pink slip, vouchers for 300.00 at race track, speakers, CD disks, sports bag, etc. Filed report w/police. Garage ins would pay if not recovered in 30 days. Police found car & driver bought it from someone else. Cost me 170. to get out of impound. Police holding keys for evidence. Do I have to pay for the repairs since it was stolen from repairgarage? Can I claim the stolen stuff from car for garage to pay & broken lugs on tires and broken box as tried to remove radio etc. What can I do or should I do? Thanks for answering.

Regardless of what the insurance co says, make a claim for all your damages and bring a small claims suit if not paid.

Calculate how much damage was caused, including personal items stolen, broken items that need repair, loss of use (i.e., if you were to rent a similar car how much would you have paid for it?), time lost from work, etc. If your loss is more than the repair bill then show it to the shop and ask them to pay the difference.

Otherwise, you may negotiate with them to settle with you without asking for payment. Good luck.
