Legal Question in Civil Litigation in California

Do we have a case?

My son and his friend (9 and 10 year old) were basically bribed/enticed by an employee of a big arcade company to sniff powdered candy into their noses cocaine-fashion (in a line) in front of the manager. Police were called and I was advised by them to call an attorney and sue the company and the employees. The parents of the friend and I would like to pursue this if we truly have a case. Was a crime committed? In our eyes as parents and the cops, yes, but will the judge/jury think that a crime was committed? Also, is there an option where the attorney gets paid a percentage if we were to win? Thank you for your time and help.

You should make sure that the children seek immediate medical treatment to document their injuries. Regardless of whether a crime was committed, I think you may have a case against the arcade and its employees for negligence (which is easier to prove than a crime). If they plea to criminal acts, it will only help you.

There are several causes of action: Negligence, Intentional Infliction of Emotional Distress, Negligent Infliction of Emotional Distress, Assault & Battery, False Imprisonment. All, except negligence, carry punitive damages. The real question here is did the kids suffer some type of injury, either physical or emotional. We would be happy to discuss the foregoing with you.
