Legal Question in Civil Litigation in California

What associated costs can be recovered by a Witness who travels to a depostion?

I have been asked to provide a depostion which is being held 60

miles from where I live for a case that my previous employer is

involved. I'm taking time away from my new employer to provide

this testimony and I'm a salaried employee. I will incur travel time,

time to give testimony, car driving expenses and parking costs.

What costs will be reimbursed and am I entitled to any kind of a

stipend since I'm a third party to this case?

Don't expect to get rich off the government allowance. You're entitled to a witness fee of $35 per day and and mileage actually travelled both ways multiplied by 20 cents. You may demand the fees before you even open your mouth to testify.

You might want to ask them if they will come to you for the dep, particularly if you haven't been served with a subpoena.
