You left out too much information for us to respond fully to your question. You can get more information if you goggle deposition, notice time. If they are not asking for any records/written material to be produced then then have meet the 10 day notice requirement, plus 5 days for mailing. You do not need to respond if you will appear at the depoistion; if the date is bad, call the plaintiff's attorney to schedule a mutuallly convenient time. Any objections to the deposition must be filed at least three day before it occurs. You may or may not need an attorney there to prevent you from giving answers that will harm your case. You should consider having an attorney prepare you for the depostiion at least. It will cost you some money [about 1.5 hours for a good preparation] but unless it is a small or open and shut case, such as an unlawful detainer, it likely will save you much more than the attorney fees [plus you can get an opinion as to potential liability and damages].
