Legal Question in Civil Litigation in California

Personal agreements

I have signed an agreement to share a road easement and I have not received a copy of the agreement. How can IO force the other party to deliver a copy to me?

Re: Personal agreements

By your question, I assume that you have requested a copy from the other party and that they have refused. If the document has been recorded (which it should have been), you can obtain a copy from the recorders office. Otherwise, you would need to go to court to compel them to turn over a copy. However, this seems needlessly expensive just to obtain a photocopy of a document.

Do not honor the easement until you get a copy

Re: Personal agreements

If you do not get a copy, go to the county recorders office and acquire a copy. You should probably go to the recorder's office anyway just to make certain the easement has been recorded and that this uncooperative person is not pulling something. Call to discuss. 800-685-6950
