Legal Question in Civil Litigation in California

Punitive Damages in a Breach of Contract Action?

My son-in-law and daughter have filed a small claims action against me for $5,000.00 punitive damages, claiming I agreed that they would be able to buy my house and when I listed my home for sale, I did not give them a chance to buy it. They are also claiming that they over paid $1,395.00 in rent.

The two of them never made an offer through my real estate agent. They asked the agent what the listing price was and were told $165,000.00. Their credit history is deplorable and their income very low. The agent merely told them they would never qualify for a loan on the house.
