Legal Question in Health Care Law in California

Health Insurance

I am fortunate enough to have double coverage from my company's health insurance plan and my husband's company plan. My insurance company keeps sending me questionaires to fill out asking if I have secondary insurance. Do I have to disclose this information to them? I'm afraid they might use this against me to deny a claim or coverage. I really think it is none of their business.

Actually both policies probably have a "Coordination of Benefits" provision that determines which is primary and which is secondary. It may also obligate you to make the necessary disclosure(s) at the risk of losing coverage for failing to comply with its terms.

Ask a hypothetical question to your Human Resources benefit coordinator at your employer or its counterpart. You may need to request a copy of your policy to read as well yourself.
