Legal Question in Immigration Law in California

h1 to h4

Hi Sir,

Let me give a brief history of my case:

I got H1 from my employer. Then my wife got H4 based on my H1 and came into the country in 2006 September. With a h4 visa valid till Oct 1 2008.

In July 2007 she got her H1 from some consultant in Atlanta, GA. And she got I-797 with a new I94 valid starting Oct 2007 till Oct 2010.

Last month she went to India and planning to come back before Oct 2008(before her H4 visa stamping expires).

I consulted one lawyer and he said there will not be any problem as he got valid valid visa stpming in her passport.

I am still little worried about the out of status because of all the h4 and h1 messup.

Could you please let me know if we are in safe zone?

She should be fine. Why did she wait this long to go get her passport stamped with the new visa from india?
