Legal Question in Immigration Law in California

For the newly announced Deferred Action: What if I met all the criteria but was not present on June 15th 2012. What if I happened to come back to my home country to attend my grandfather's funeral? and I still have a job in the U.S. with my EAD card that is still valid.

I am still paying utility bills and etc. Would I be able to apply providing those evidences even if I was not present on that date? Should I end my trip and go back as soon as possible? Please let me know if you know any information. It really makes a huge difference in my life.

The final rules have not been made, but at this time it may well be that you are out of luck. The issue of how you intend to re-enter the US at this time is another consideration, and any bars you may trigger in having left after unlawful presence in the US and another unlawful reentry.
