Legal Question in Immigration Law in California

second ( parallel) H-1b

What is the procedure and conditions for applying for a second H-1b visa ?

I am currently on H-1b with company A and will be transferring my visa to company B. The company A is still interested in giving me some part time work as consultant. What will be the procedure for it and are there any conditions that need to be met to be eligible for the second H-1b ? Also how soon can I start to work on this second H-1b after applying for it ?

Thanks in advance for your reply.

Hi

You can apply for a second H1b while keeping the first one. Alternatively you can apply for a second one as a transfer H1B.

Once the second case is send out in the mail, you can start working for the new employer even before approval. This is under the new portability rules.

You can have company B file H1B for you and start to work once you receive the receipt. You also need to have company A file H1B amendment to change your work time from full time to part time.

For more information about H1B conditions and procedures, please visit my firm's website (www.askwang.com) or send me an email.

Re: second ( parallel) H-1b

Thank you for your inquiry. You would be eligible to begin work with company B on the day the USCIS receives your H-1B application. Company A, because the conditions of your employment have changed, should file an amended petition on your behalf. Please feel free to contact me directly if we may be of assistance at 619.233.0900 or [email protected]
