Legal Question in Immigration Law in California

Currently TN would like permanent status

I am Canadian and am on a TN visa. My husband is also Canadian and on a TN visa. One of our parents has their US citizenship and lives in Canada. We would like to obtain permanent US status (ie able to work in US without TN visa indefinitely). We would like to know what our most successful options are.

Straight answer: the easiest option is through the parent filing an I-130 for you to classify you as their child. Even after that is approved, the waiting list for married children of US citizens (about 6 years presently) must be endured before you can file the application for permanent residence and work permit. Meanwhile, to remain in the US you would have to maintain your TN status or status through another work visa category. Employment immigration could work and would be a little bit shorter, such as a 3 to 5-year wait. But that isn't as sure of a thing because it depends upon the cooperation of a willing employer and a lot more paperwork.

That parent may be able to petition for you. Also, you may want to consider a nonimmigrant status that will allow you to adjust to permanent residence through your job.

You may be eligible on your own through the lengthy process of obtaining lawful permanent resident status through employment, or if you are eligible, you or your spouse may be able to apply through your US citizen parent. If you have parents that are a citizen, your most success would come from a petition from them, allowing you to stay here as a permanent resident. There are other ways, such as marrying a U.S. Citizen, but only by sitting down with an attorney and going over all your options are you going to know what may work and what will not.

There are a variety of ways to obtain your green card, some are employment-based and others are through family-based petitions. From what you have stated, you do have ways to obtain permanent residency.
