Legal Question in Insurance Law in California

Had no insurance during an accident !

I recently had an accident--name removed--april 29th where the other party struck me, and i had no insurance. I paid out--name removed--pocket for my automobile to get fixed yet the other party's insurance (AllState) is calling me and sending me mail reagrding the accident. What are my rights when it was his fault and i had no insurance coverage at that time. I do now but it is after the fact.

You can recover the cost to repair your car from the other driver and therefor from his insurance company.

If he was at fault, you can recover the repair costs plus loss of use of your car while it is being fixed. However, beware that the insurance company may sue you for the damage to his car if they know you are uninsured. I have talked about this on my blog, www.calpiblog.com.
