Citation for drinking at a party?

I got a citation for drinking at a party and I have 2 prior arrests for shoplifting. Ive been on a 3 month diversion agreement which I got off with 20 hours of community service and an essay to write. Will I go back on probation for getting the citation or will I just have to pay a fine?

The terms of your theft diversion probably include a "violate no law" provision. The citation you got for drinking (I assume you're under 21) would be a violation of the Business & Professions Code - minor in possession of alcohol.

You could be found in violation of your underlying probation (or diversion) and sentenced on those cases. The goal of your diversion - to keep clean and get the theft charges off your record - is now in jeopardy.

Even though it's "only" a citation, you could be facing new misdemeanor charges as well as the two priors. It's time to discuss this with an attorney to try and clean things up with you.
