Legal Question in Employment Law in California

Commission earned but unpaid

I have concerns about getting paid commissions earned but not due according to commission plan. Commissions earned are paid when product is installed per comp plan. The concerns arise from employer providing false information on commission pay that is due status and trying to defer payout. I have alot of commissions pending from contracts signed since Nov 2007 and I am concerned that my employer is weighing termination vs payout due to financial difficulties at the company. Looking for some advice, willing to pay to have a local expert on this sort of thing (OC) look over my compensation plan and advise. Thanks

Re: Commission earned but unpaid

Commissions are due and payable to the employee once earned. As you suggest you should have an attorney review your employment (commission agreement) to determine when and how your commission is earned and calculated.
