I have been employed for four and half years if I am laid off or I choose to leave does the company have to pay my unused vacation?

Yes. your vacation is considered wages. Most employers know that and include vacation pay-out in the final paycheck.

Mr. Itkin is correct. Also, if they do not pay it out at the same time your final pay check is due, they will owe a waiting time penalty until it is paid, of one-days pay for each day the pay-out is late.
