Legal Question in Employment Law in California

Employer Confidentiality Breach

A friend is negotiating with their employer of 20 years for a voluntary buyout. The specifics have not been agreed to yet, in terms of money and health care, etc. Naturally, this is supposed to be a secret between him, his boss and the HR department. Yesterday a colleague asked him when his last day was. Since the company is also laying a large number of people off at the same time, he feels that his reputation and his ability to earn future income in the industry is compromised now that it seemsv his status as voluntary is compromised and his departure is common knowledge. Does he have any advantage in the buyout negotiations? Does this suggest additional legal action on his part?

Re: Employer Confidentiality Breach

They will want your friend to give up his right to sue in return for the severance payment. If he has credible legal claims that would serve as leverage in buyout negotiations -- unknown from your posting whether he has such claims. . . .
