Legal Question in Employment Law in California

Former employer using me in his television commercial

I was asked to appear in a television commercial for a former employers business and have a very predominent role in the television commercial.I was never asked to sign any release or authorization to be used in the television commercial.Shortly after the commercial was filmed,I was terminated from my position with the employer. The employer kept running the commercial in my local community and it caused me much embarresment when people in the community asked me about the commercial and I have to explain I had been fired from my job at dealership. Is it legal for them to air the commercial from the beggining without my permission or consent? What rights do I have to sue them for the humiliation, embarassment and shattered confidence as well as mental pain and suffering this has caused me from this cruel and careless act? My confidence has been so shattered from this terrible situatuation I have not been able to get a job since I was fird by them. Can I sue them and on what grounds?

Re: Former employer using me in his television commercial

If you did not sign any authorization it may have been implied because of your aquiessence to the filming. Did you have a written contract whatsoever with your employer? If you performed in the commercial with the expectation of being compensated for it, then you may have an action in "quasi-contract" called "Quamtum Meruit."
