When I recieved and accepted the offer letter a month prior to my start date.I had already mentioned to in writting that there is a discreptancy with my name spelling and birthday due to mistakes by mu parents. I brought in all the necessary paperwork with me to show them. But they through me out and did not even explain or give me time to correct anything. I am concerned about not getting paid my commission and base salary. This was a equipment leasingcompany in irvine. I could have made a lot of money with them. It does not appear from anything that you wrote that you have a claim for wrongful termination. That type of claim often requires proof of discrimination based on a "suspect class," or retaliation for complaining about something that was illegal. I see nothing like that in anything you have written.

Even if your company treated you horribly during the termination process, there does not appear to be anything that gives you a claim against your former employer for wrongful termination.

Unless you had a written contract stating that the company agreed to hire you for a certain time period, you were an at-will employee. As such, the company can let you go for any reason as long as it is not based on a protected class (age, race, gender, pregnancy, medical condition, religion, etc.) or because you asserted a legal right of your own, such as overtime pay or if you were a whistleblower. Based on the info you provided, it does not appear that you have a wrongful termination case. However, when an employee in CA is fired, they must receive their final paycheck that day. If not, the company will have to pay the wages owed plus one day's pay for each day you have to wait for your check - up to a maximum of 30 days PLUS attorneys' fees. Call an employment law attorney. Most of us offer a free initial phone consultation and take these cases without cost to you. 949-481-6909 Law Office of Kristine S. Karila
