Legal Question in Employment Law in California

Does an unemployed spouse qualify for FMLA, if her husband has been declared permanent and stationary, due to a work related injury (employer large utility in so cal)? This is in the State of California, County Of San Bernardino.

FMLA applies to employees who need to take leave from work to care for a spouse or close family member. If you are unemployed, I do not see how you could qualify because you do not have a job to take leave from.
