Legal Question in Employment Law in California

Wrongful Termination

I was tasked with growing sales in one geographic zone of a business group. The entire group (all 7 zones) had an increase of 446K for the 07 fiscal year. My zone was responsible for 444K of the increase. The reason given for the termination was elimination of position. There were three such positions nationally. I was the top performer and accomplished what I was asked to do yet was the only one fired. I have spreadsheets that accurately document my sales and the sales of the other zones in the country. There was no warning of any kind regarding a deficiency of my performance. I was with the company six years and was offered a severance of six weeks. I feel I am entitled to more than six weeks and that I was wrongfully terminated and may be entitled to damages. I was given ten days to agree with the terms of the severance as of 11/15/07. Please respond soon as I must have a course of action if I choose not to sign the agreement.

Re: Wrongful Termination

Based on your statement I dont see any facts that would provide for a wrongful termination claim. However, you should consult an attorney for a more definitive statement. Your severance agreement should also be reviewed by an attorney before you sign it. There is no way to provide you with a course of action without knowing all the facts of your particular situation and reviewing your severance agreement.
