County vehicle rear ends my car at a stoplight

My secretary was at a stoplight after work yesterday when a County car failed to brake and slammed into the back of her car at about 40mph causing more damage to her auto than the Blue Book value. She sustained a sore neck and the County driver said that his brakes had failed and he admitted fault. The County rep said that she would need to fill out a claim form to recover and ''within 45 days or so we will get back to you.'' She told her insurance company and they said they can't guarantee that they would not raise her premium. So now she has a ''totaled'' car whose Blue Book was $12k and the County told her that they could only pay her $9k. They did not tell her to go see a Doctor nor did they tell her that they would pay for a rental car. What should she do?
