Legal Question in Personal Injury in California

excessive force

My son was out pass curfew when a

cop tried to stop him. My son who is

16 refused to stop. The cop told him

he was going to hand-cuff him and

take him in. My son tried to keep his

hands moving so that the cop could

not hand-cuff him. The cop called for

back up. They then slmammed my

son against a metal fence, fraturing

both his cheek bones. They took

him to the police station, then

juvenile hall and then to the

hospital. Did they use excessive

force against a minor?

Your son is lucky it wasn't worse.

You are assuming he was truthful with you. My experience is that I would question your boy thoroughly, and my best guess is that your boy had a juvenile record before this!
