Legal Question in Personal Injury in California

I need a new Lawyer

I understand that I can change lawyers without an penalty in California. I have an attorney that I feel is not working in my best interest, in that, he does not return my calls and I do not here from him unless I call him. The problem is that I have two Traffic accidents pending with this attorney. One since 12/00 and the other 10/01. There appears to be no movement on either matter. I need a new attorney to get thing going again.

You are correct -- there is no "penalty" whatsoever for changing attorneys. However, a new attorney will have to get up to speed on your cases and, hopefully, work out an amicable fee split with your current attorney. Also, your current attorney is entitled to compensation for the work he/she is done if a settlement or judgment is obtained.

Your attorney has a duty to communicate with you and keep you informed of case developments.

Have you tried to write him/her to express your dissatisfaction? He/she may have pressing deadlines in other matters. Nevertheless, your calls should always be promptly returned.

Remember, the attorney works for you.
