can a lPlaintiff re-instate or re-file a lawsuit after the case was a volutarilty dismissed by the Plaintiff without prejudice if you believe the attorney representing the Plaintiff gave the Plaintiff bad advice to do so ?

Yes, you can, unless you are beyond the statute of limitations. It does not have anything to do with bad advice from an attorney. If there was a mistake, you may need to look at Code of Civil Procedure, � 473 to correct mistakes.
