Legal Question in Personal Injury in California

should i pay the deductible?

I got into an accident driving my friends car and he gave me full permission to drive it and his insurance will cover it but should I have to pay the deductible and he was the one at fault by letting me drive his car? The insurance covers the car not the DRIVER!! Should I pay the deductible?

Re: should i pay the deductible?

Since you were the one who wrecked the car you are responsible for all of the damages including the deductible. Were you insured on your own car? If you were your own insurance company may cover you in this accident and they would be responsible for the damages. If you were not insured the insurance company may come after you not only for the deductible but for all the damages that they had to pay on the accident. Hopefully, if you pay the deductible they won't come after you for the full damages. If they do and you need help defending yourself please feel free to contact my office at 888-563-8529. The call and consultation are free. I might be able to convince them that you have no money so filing a lawsuit against you would be a waste of time. I look forward to speaking with you regarding your rights.

You are responsible for the deductable only if the accident was your fault.
