When I rent a building for a group at a resort and one of my group falls down the building steps and breaks her arm.

Who is responsible, me or the resort?

That will depend on why she fell. Was the floor wet from being mopped, without a warning cone? Was there a loose handle that caused her to loose her balance? Or, did she simply loose her balance and fall? These, and many other questions must be addressed when evaluating a personal injury, slip/trip and fall case.

What Mr. Lupoff is saying is that liability depends on the cause of the accident. Unless something you did or failed to do, or the resort did or failed to do, caused or contributed to the fall, neither you nor the resort are responsible.
