Legal Question in Personal Injury in California

Salon damage

I got a perm on monday 1/11/99 and could wash it out the first time on wednesday 1/13/99. on that night i noticed bald spots all over my head as if someone had shaved little spots all over the place and that when i brushed it handfuls of hair were falling out. on thursday 1/14/99 i called the store where the salon is located and talked to someone and told them i wanted my money back, no problem no hesitation. i then went to another local salon to get their opinion of why my hair is still falling out and they said that the bald spots were from the rolling and the falling out was from the chemical reaction. i am to talk to the manager of the salon tomorrow, friday, 1/15/99, and i want to know if i can expect more than just the refund and the recontruction conditioner, for the mental anguish this has caused and for the terrible regrow that will be happening for the next however long? i know not to sign anything, just in case i do want to push it, but is it a reality to get anything more? i have very long hair, approx mid back. i also want to know how to go about getting compensation from the store manager. this is a very large department store.

It sounds like you have an excellent case for negligence. Such a case would involve an award of damages in excess of your fee to the salon. You would also be able to sue for emotional distress, and this would most likely be a large portion of the damages. If you have any permanent damage which requires medical attention, this would also be included in the damages.

Although you say you are to speak with the manager on 1-15-99, your message was only posted on 1-26 (the LawGuru people got a bit behind after a recent software upgrade, and have been dealing with the backlog for some time now). I hope you didn't sign a waiver or release when you met with him, as this might well preclude a subsequent lawsuit.
