Slip and Fall Accident

I slipped and fell at a restaurant this past May 2003. I have had re-occuring pains from the hip and back since then. The owners daughter was right there as I slipped and fell in front of the employee who was mopping the floor without a wet floor sign. The whole floor was wet and I had on heels. The owners daughter came to my side to see if I was alright and my hip felt funny, but i didnt do anything about it at that time. Now, I am having re-occuring pains on the leg that was twisted when this occurred. My husband was about 10 feet away and also witnessed the accident. What should we do? Please advise? There were several people who witnessed the accident.

If you didn't get medical treatment in a 'timely' manner, you diminished any case value, because you have not incurred any damages on which to base a claim. IF you now have been treating with a doctor, and your doctor is willing to provide a report that the injury and symptoms are clearly the result of the fall, then you have some argument and basis for claim, but it is probably not going to be of much monetary value without medical bills and wage loss promptly after the incident. The majority of my case load presently are premises liability cases with the majority of these being slip and falls. I concur with what the previous attorney said about promptly seeking medical treatment. Hopefully you have sought treatment already. It has been it appears approx. 5 months since the accident. It does appear to me that you have a good case as far as liability, however damages may be a problem if you have not treated.
