Legal Question in Real Estate Law in California

My husband had me quitclaim the house to him, just a few days after I was released from a substance abuse rehab, telling me that was the only way he would stay with me. I signed it and now he is divorcing me.

Are his actions legal?

I would say that this sounds like a case of promissory fraud and that with good factual evidence and proper representation, your chance of having the transfer set aside are pretty good. You should ask your divorce attorney whether he/she can handle this within the divorce proceedings or whether this should be raised in a separate court action with a specialist in fraud matters representing you.

It is very likely that the quitclaim deed will be ignored or voided by the divorce court, but you are going to need a good divorce lawyer to make that happen. I strongly recommend you find a good lawyer immediately.
