Legal Question in Real Estate Law in California

My neighbors large pine tree is causing my pool deck to severely lift creating a fall hazard, the pine needles continually eat through pool motors, the root system is tearing down my reining wall again and the pine straw and cones continually clog my pool drains to where I have to have them snaked. Th deck is a fall hazard. All of these problems are due to the root system according to an arborist. I have asked them nicely to cut the tree down but have received no response. Do I have legal recourse?

Your neighbor is responsible for the damage to your deck, drains, etc. You might suggest to your neighbor he or she contact their homeowner's inusrance.
