Fired for ''unprofessional conduct'' when I called manager an a-s-ole after he w

Do I have a case if I was being sexually harassed by my manager and when he wouldn't take no for an answer I called him an asshole and he fired me the next day for ''unprofessional conduct''? The place of employment is a bank in California.

It is illegal to sexually harass someone and fire them in retaliation for complaining about the harassment. Given the circumstances, I do not think calling him that name is going to be a problem in a suit. If want to discuss further, please call me at 805/641-6600.

sexual harassment can occur two way typically: 1) quid pro quo type, in which the offender's conduct must be so egregiously outrageous that it warrants "damage" recovery..it can occur over time or can occur just once depending on the severity. 2) hostile work environment sexual harassment, in which there is an ongoing pattern of sexual harassment against you by the offender and you have told the offender to cease and desist such further conduct or reported it to your supervisor or HR department, yet the sexual harassment still continues regardless. from the facts you have given thus far, you may VERY well have a strong case against your manager for one or both types of sexual harassment i just mentioned. feel free to email more specific details regarding your situation and your manager's behavior before and up until your termination, and i will be able to further assist and/or represent you legally in this unfortunate matter.

IF you can corroborate and show evidence of the sexual harassment by the manager, then you may be able to overcome the 'for cause' firing. Insubordination is always grounds for firing. Contact me to discuss the evidence supporting your claim, and the procedures now.
