Legal Question in Sexual Harassment in California

� The victim does not have to be the person harassed but could be anyone affected by the offensive conduct.

This is where I am, I am in a condition of unreasonably interferes with an individual's work performance or creates an intimidating, hostile or offensive work environment. I have no desire to go to work or to be there. I have worked there for over 10 years. This is the problem my wife worked at the same place and she had an afrair with another co-work. She no longer is working there. I do have to work with the other co-worker and have to see him. My empolyer has done nothing to him or I. What are my options?

There is no law against two consenting adults having an affair. Nor is there any obligation on the employer to discourage such activity. In fact, to do so might even violate their right to privacy. You do not have to work with the individual or for the company, but you cannot sue the employer because you feel uncomfortable in that environment.
