Legal Question in Sexual Harassment in California

Sexual Harrasment

I was sexually harrassed in 2001 by my high school teacher in a classroom with about 25 students present. It was done on several ocassions although, there was no physical contact the language was extremely graphic. I know want to take action against the school and teacher what is the statue of limitations in this case?

If you were 18 or over, you had one year to bring your claim. If you were under 18 at the time, theoretically you would have until your 26th birthday to bring suit. Assuming you could bring suit now, you would have to prove your case, meaning: that it happened, that the conduct was 'illegal', that it was sufficiently offensive and extreme to be actionable, and what your reasonably incurred damages are.

If there were 25 students present, it sure doesn't sound like it was sufficiently obvious, severe, outrageous, or offensive at the time for someone to report it. If you mean by 'harassment' that you were embarrassed about something said, that is a great deal different than sexual molestation or abuse. Any attorney reviewing this is going to require provable conduct that would shock and offend a jury sufficient to give you a large monetary award.
