hit by a speeding car while making a left out of driveway

i was attempting a left out of the driveway with plenty of room when i noticed a speeding car. i stopped, but the other car was coming so fast, it hit the car anyways. he claims he was going 25, but there is a witness willing to testify that he was way over the speed limit. the speeding car had minor scratches. his insurance company is asking for compensation because i was uninsured. does the other car have the right of way even though he was speeding?

When one stops at a stop sign or driveway exit and it reasonably appears to be safe the driver has the right of way. However, you should weigh the cost of defending this case against the cost of buying your way out. If you pay make to get a full release of all liability.
