Legal Question in Traffic Law in California
Ive been sued, but they think im someone else
I was a WITNESS to an accident. I offered my name, address, and phone number if they needed my statement. Numerous times, they called me asking for my car insurance info and sent letters claiming i was the person at fault in the accident. They obviously have the wrong person. I was given an ORDER to go to small claims court because they think i was involved in the collision.
The sheriff listened to my situation and said i should counter-sue for harassment as well as ask my insurance provider to see if they'll help me. I even believe they are trying to scam me. What should I do?

Report the situation to your auto insurance company. Let your insurance deal with this person. They are better equipped and funded to deal with insurance fraud.
