Legal Question in Wills and Trusts in California

We have an account that was in mothers name she passed away and we are trying to change over to fathers name they are asking for death certificate and proof of inheritance. what is proof of inheritance?

I am sorry for your los. Most likely a California "small estate affidavit" pursuant to California Probate Code 13100 will suffice. This would be done 40 days after death. Mr. Palley did not answer your question. Even if you use a small estate affidavit, you will still need proof of inheritance. That means they want to know if there is a will, or a trust. That information is relevant to determine whether your father inherits, or someone else named in the will or trust.
