Legal Question in Wills and Trusts in California

How to choose a guardian

My wife and I just had a new babay, and I am about ready to meet with an attorney to create my family's trust and will, and my wife and I disagree on who to choose for a guardian. I want my similarly aged brother who has a family all set, and she wants her parents (baby's grandparents who are in their 60's). Why is it better to have a younger person with a current wife and small children be the guardian? Are there standard objective factors I can pooint to in making this decision?

Re: How to choose a guardian

your qustion is framed in your favor. you should look at what objective as well as subjective factors are to be considered. more likely than not these people will never be the guarians over this or any of your children since one of you will survive until the child will reach the age of 18. this does not deminish the need to name a primary guardian(s) and a secondary guardian(s). i suggest asking the attorney what factors he/she iders most important. remeber the attorny has much more experience than both of you but there is a midpoint which you can take and no one can tell you whether your choice is good or bad, only the future will tell you and if this does come true you won't be here to see if you were right or wrong --- good luck and remember this can always be changed in the future.
