Legal Question in Wills and Trusts in California

will

My brother is the trustee for my grandfathers property. We are the beneficiaries he sold the property and bought a house for himself. I asked him for a copy of the will and he refused. How do I go about getting one?

Re: will

He couldn't sell the house if it was in your father's name without going through probate court, unless your father left a trust, not a will. You need to retain counsel, ASAP!

You are entitled to a copy of the trust and will and may petition the court if the trustee/executor refuses to provide it to you. Contact me directly.

Re: will

Has your grandfather passed away? If so, the trustee must provide a copy of the trust to you. If he refuses, you should not delay in consulting with an attorney to assist you.

Please give my office a call if you want to discuss this further.
