Legal Question in Workers Comp in California

Eligibility for Worker's Comp

My doctor and employer have both suggested I take Workers Compensation for the disabling pain I get in my neck when under extreme stress (which is often in my industry).

I have had lower back problems most of my life (but not neck) - would this eliminate me from being able to get WC? Would I be denied by an examining doctor if I'm not having a flare-up at that moment?

Re: Eligibility for Worker's Comp

It doesn't sound as if your neck pain is related to the low back pain you've had. A doctor may be able to discover objective causes of the pain even if you were not symptomatic at the time. It is important that you choose a doctor experience in helping applicants in workers compensation claims. Contact me directly at (619) 222-3504.
