Legal Question in Workers Comp in California

Workers' Comp Rights

I have been on modified duty since I incurred an upper back and neck injury at work last August. This week I was notified by my employer that I will no longer be able to work on modified status after next week and must stay home and accept disability payments. Is there a time limitation re: modified positions? If I am at home and receive disability payments, will it ever affect my future hireability? I am concerned that I will be labeled and my options will be limited as a result.

Accidents are very unfortunate, you may suffer from a permenant disblity which will prevent you from taking similar jobs in the future. There is no time limit on modified work positions, it may just be that the position is no longer available. Be assured that it is illegal to discriminate against one who has filed a worker's compensation claim. Legal remedies are available for those who are discriminated against.
