Legal Question in Workers Comp in California

Can you sue your employer for equipment failure if it causes an injury?

My employer has Worker Comp Ins and I was injured last year due to equipment failure. We have not settled and I would like to know can my employer legally be held responsible for the equipment failure? I am recieving Worker's Comp benefits.

Certainly you may have a serious and willful misconduct action if the equipment was poorly maintained. You may also have a products liability action against the manufacturer.
